释义 | 雙重懲罰 The punishment of an offender more than once for the same act or omission under two or more statute or at the common law. However, double punishment is prohibited: Bill of Rights Ordinance (Cap 383) s 11(6). Disqualification following a fixed penalty ticket was held not amount to a double punishment as disqualification is not a punishment but rather the civil consequences of an offence: R v Wan Kit Man [1992] 1 HKCLR 224.
