Betting, gaming and lotteries - A thing of value which the managers of a lottery propose to award to the winner of the lottery. The distribution of prizes must solely depend on chance, and if the winning of a prize involves the exercise of any skill, then the activity is not a lottery: Imperial Tobacco Ltd v A-G [1981] AC 718, [1980] 1 All ER 866 (HL). In common law, a contract as to a prize competition could be enforced: Simpkins v Pays [1955] 3 All ER 10, 1 WLR 975. Examples of prizes are money, motor vehicles. In Hong Kong, contests organised in connection with programmes broadcast by a licensee under the Broadcasting Ordinance (Cap 562) shall comply with any Codes of Practice which may provide for limitations on the types of prizes which may be awarded in such contests and the maximum value of such prizes: Broadcasting Ordinance (Cap 562) s 37. For example, certain prizes, such as tobacco products and alcoholic liquor, are not to be presented as prizes in contests broadcast in a domestic free or pay television programme service: Generic Code of Practice on Television Programme Standards ch 2 para 6 (2003). Education and research - An award for excellent performance in academic studies. A prize may be awarded for outstanding performance in a single subject or in a course of study. It may be donated by a philanthropic body or trust, or by commerce and industry. The conditions on which a prize is to be awarded will be determined by the internal statutes and regulations of the educational institution. See also Scholarship.
Maritime law - A ship, goods, or other property captured from an enemy or neutral national at sea or within a port under the rules of prize law: Re Genoa and its dependencies, Spezzia Savona and other towns (1820) 165 ER 1541. Matters concerning prizes will be adjudicated in special courts, such as Prize Court and Naval Prize Tribunal: Steamship Canadia [1921] 9 Ll L Rep 339. See also Prize law; Ship.
