释义 | 法例的有效性 The validity of legislation is contingent on the constitutional basis upon which the legislation is passed: legislation is valid if it has been legitimately and lawfully passed by the legislature in accordance with the provisions of the Basic Law and legal procedures. The validity of legislation made in the exercise of powers conferred by or under a statute can normally be challenged in the courts (Institute of Patent Agents v Lockwood [1894] AC 347 (HL)), whereas statutes are generally immune from such challenge except under the Hong Kong Bill of Rights Ordinance. 法例的有效性是視乎通過該法例的憲法基礎而定:由立法會根據《基本法》條文,及按法律程序正規地及合法地通過的法律方為有效。通過行使藉法規賦予或透過法規賦予的權力而制定的法例,其有效性通常可在法庭提出質疑(Institute of Patent Agents v Lockwood [1894] AC 347(英國上議院)),然而法規一般免受此等質疑,但根據香港人權法案條例所提出的質疑則除外。 |
