1. To pass a thing or try to pass it as genuine: Selby v DPP [1972] AC 515, [1971] 3 All ER 810 (HL). For example, it is an offence to offer, utter, dispose of or put off any register of births, baptisms, marriages, deaths or burials (which is by law authorised or required to be kept in Hong Kong), knowing the same to be false: Crimes Ordinance (Cap 200) s 88. 2. To speak or pronounce. For example, it is an offence to utter any seditious words: Crimes Ordinance (Cap 200) s 10(1). No action will lie against counsel in respect of words uttered in the course of any judicial proceeding: Marrinan v Vibart [1963] 1 QB 528, [1962] 3 All ER 380 (CA). In relation to letters threatening to kill, ‘uttering’ is the intentional placing of the letter where it is likely to be seen and read by the person to whom it is directed or be found by someone who is likely to convey it to such a person: R v Jones (1851) 5 Cox CC 226.
