Product liability - A person who suffers personal injury or property damage as a consequence of using or consuming a product, but who has neither acquired property in nor title to the product: for example Donoghue v Stevenson [1932] AC 562. If a manufacturer sells an article in such form as to show that it is intended to reach the ultimate user in the form in which it left the manufacturer with no reasonable possibility of intermediate examination, the manufacturer owes a duty to the ultimate user to take reasonable care in the manufacture of the article so that it will not result in injury to the user: Davie v New Merton Board Mills Ltd [1959] AC 604, 1 All ER 346 (HL). However, the manufacturer is not liable if the user in fact had prior knowledge of the defect (Grant v Australian Knitting Mills Ltd [1936] AC 85 (PC)), or if the circumstances would warrant the manufacturer to assume so (London Graving Dock Co Ltd v Horton [1951] AC 737, 2 All ER 1 (HL)). It is common to have a restriction on user in the Government lease, which will restrict the use of the property, for example, residential (for example Donald W Shields (No 2) v Mary Chan [1972] HKLR 121; A-G v Lo Hoi-ming [1965] HKLR 1152), industrial (for example Mexx Consolidated (Far East) Ltd v A-G [1987] HKLR 1210) or agricultural purposes.
