| 释义 | 律師及其當事人的訟費令 An award of costs that provides for costs to be paid on a more generous scale under the taxation of costs system than is the case with party and party costs: Hang Tak Co Ltd v Chu Ying-lun [1965] HKLR 650; Wing Hang Bank Ltd v Liu Kam Ying [2002] 2 HKC 57. On an application made within one month of the delivery of the solicitor’s bill, the party chargeable may apply to the court for the taxation of the bill and the court may order that the bill be taxed and that no action may be commenced on the bill until the taxation is completed: Legal Practitioners Ordinance (Cap 159) s 67(1). On occasions the court has ordered costs as between opposing parties to be taxed on the solicitor and own client basis and the parties are free to contract that any costs between them will be taxed on this basis: GTE Directories (HK) Ltd v Mo Yung Kwok Wah (t/a Sun Hing Co) (CACV 155/85, unreported).
