| 释义 | 擱置執行 The suspension of the operation of a judgment or order. For example the court has the power to order stay of the execution of the judgment or order by writ of fieri facias either absolutely or for such period and subject to such conditions as the court thinks fit. A stay may only be granted if the court is satisfied that there are special circumstances which render it inexpedient to enforce the judgment or order or that the applicant is unable from any cause to pay the money: The Rules of the High Court (Cap 4A) O 47 r 1(1); Prestige Publications Ltd v Chelsea Football and Athletic Co Ltd (1978) 122 Sol Jo 436 (CA). Under the rule, the court only has jurisdiction to stay execution by way of fieri facias and it cannot be extended to other modes of execution: Kwantung Provincial Bank v Cheung Tin Ming [1992] 1 HKC 344. 暫時停止判決或命令的實施。例如法庭有權憑藉扣押債務人財產令狀，無條件地或按法庭認為適合的期間及條件，命令擱置執行判決或命令。如法庭信納有特殊情況不宜強制執行該判決或命令，或申請人由於任何因由不能支付該筆款項，則才可授予擱置執行令：《高等法院規則》（第4A章）第47號命令第1(1)條規則；Prestige Publications Ltd v Chelsea Football and Athletic Co Ltd (1978) 122 Sol Jo 436（英國上訴法院）。根據此規則，法庭只有憑藉扣押債務人財產令狀擱置執行的司法管轄權，而不可引伸應用於其他執行的方式：Kwantung Provincial Bank v Cheung Tin Ming [1992] 1 HKC 344。 |
