Any asset that perishes or becomes worn out, either with use or by lapse of time, is of wasting nature, including buildings and machinery erected for trade purpose. If the property is permanently diminished or injuriously affected, the owner should realise part of the capital of his property as distinct from merely exploiting its income-producing character: Nethersole v Wither (HM Inspector of Taxes) [1946] 1 All ER 711 (CA). In trusts law, if trust property has become wasting property, it is the duty of the trustee to sell and convert the property and invest the proceeds in permanent investments of a recognised character for the benefit of the beneficiaries: Re Bates, Hodgson v Bates [1907] 1 Ch 22.
