释义 | 有條件饋贈 A bequest or devise by will that is subject to condition, which are consistent with other provisions of the will and must not be unlawful nor contrary to public policy. The condition must also be certain and capable of being complied with: Halsbury’s Laws of England (4th Ed) Vol 50, para 367 et seq. If the condition is satisfied, the interest in the property passes to the named beneficiary in the will; if the condition is not fulfilled, the gift does not take effect and falls into residue. If the condition is a condition precedent, there is no gift intended at all unless and until the condition is fulfilled. If the condition is a condition subsequent, non-compliance with it is intended to put an end to the gift: Re Boulter, Capital and Counties Bank v Boulter [1922] 1 Ch 75; Sifton v Sifton [1938] 3 All ER 435, AC 658 (樞密院); Halsbury’s Laws of England (4th Ed) Vol 50, para 367.
