释义 | 強迫離開 An action for the taking of possession of land: for example Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 33. Ejectment is brought by a person out of possession against the person in possession. The action can be maintained by the title holder of the land or by the previous possessor of the land. The plaintiff must prove his or her title to the property claimed and must show to have a better title: Li Chok Hung v Li Pui Choi [1911] 6 HKLR 12. An ejectment action is an appropriate procedure to stop adverse possession of land: for example Tang Shu Tin & Ors v Tang Kin Kwok & Ors [1994] 2 HKC 727 (HC). Leases and tenancies - A historical cause of action developed as ‘trespass in ejectment’ which enables a leaseholder to recover land from all comers and which prevented any other person from denying the leaseholder’s estate in the land, or that it was held in tenure. The defendant was sued as tenant in possession and the plaintiff out of possession claimed a better title to the property than the tenant in possession. Tort - An occupier’s right to remove trespassers from the land or premises occupied, using such force as is reasonable in the circumstances. If a person has entered the premises with permission, a reasonable time must be given for the person to be allowed to leave before he or she may be treated as a trespasser. Normally, even a trespasser should be asked to leave the premises before the occupier can exercise the right of ejectment, but no such request is required where the trespasser has clearly entered the premises forcibly: Hemmings v Stoke Poges Golf Club Ltd [1920] 1 KB 720 (CA).
