An invasion or apprehended invasion or attack or apprehended attack by an enemy or armed force. Traditionally, war denoted a struggle on an extensive scale designed to subjugate an enemy: Driefontein Consolidated Goldmines v Janson [1900] 2 QB 339. In Hong Kong, in case a war happens, the armed force stationed in Hong Kong by the Chinese Central People’s Government will be responsible for the defence of Hong Kong (Garrison Law of the People’s Republic of China 1996 ch 2), as the Chinese Central People’s Government is responsible for the defence of the Hong Kong SAR (Basic Law art 14 para 1). Hence, in this aspect, the Hong Kong SAR does not have its own separate law and practice governing the use of force and war. See also Armed forces; Enemy; Hostilities.
