释义 | 建築效益保證 In a building contract, a warranty by a proprietor that a design is capable of being constructed: for example Greater Nottingham Co-operative Society Ltd v Cementation Piling and Foundations Ltd [1989] QB 71, [1988] 2 All ER 971, 41 BLR 43 (CA). No such warranty will be implied: Thorn v London Corp (1876) 1 App Cas 120. It follows that a contractor cannot seek extra payment for the work required to realise the design or to achieve completion, unless a variation instruction is given. Nor is the contractor permitted to abandon or suspend the work for this reason: McDonald v Workington Corp (1893) 9 TLR 230, 2 Hudson’s BC (4th Ed) 208.
