| 释义 | 法定地役權 An easement or right or way imposed on land pursuant to a statute. It may be appurtenant only to some enterprise or may exist irrespective of any dominant tenement. Examples of statutory easements are running powers of railway undertakings over land not owned by the railway undertaking (Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276) s 6; Road (Works, Use and Compensation) Ordinance (Cap 370) s 15), easement necessary for establishing an electricity network by the power companies (Electricity Network (Statutory Easements) Ordinance (Cap 357)), and other easements relating to constructing tunnels, drains, pipes and pipelines: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0524]; Nield Hong Kong Land Law (2nd Ed, Longman) Ch 13 p 343.
