| 释义 | 法定特許 In copyright law, a licence by which a person is authorised to broadcast a literary, dramatic or musical work, or an adaptation of such a work; an artistic work or a sound recording or film, and he is to be treated as licensed by the owner of the copyright in the work to do or authorise any of the following for the purposes of the broadcast: (i) in the case of a literary, dramatic or musical work, or an adaptation of such a work, to make a sound recording or film of the work or adaptation; (ii) in the case of an artistic work, to take a photograph or make a film of the work; (iii) in the case of a sound recording or film, to make a copy of it: Copyright Ordinance (Cap 528) s 77(1), (2). The statutory licence is subject to conditions that the sound recording, film, photograph or copy in question must not be used for any other purposes and must be destroyed within three months of being first used for broadcasting the work: s 77(3).
