释义 | 法定契據的蓋章 The deeming of deeds to be sealed by statute. At common law, a deed had to bear a seal but by statute a deed must be signed as well as sealed, or if expressed to be a deed, or to be sealed, need not be sealed in fact if it is signed: for example, The Hong Kong Christian Council Incorporation Ordinance (Cap 1083) s 8. 籍法規須蓋章而當作契據。在普通法,契據須附有蓋章,但根據法規,契據須予以簽署及蓋章,或如明訂為契據,則須蓋章,但如已簽署,則不須蓋章:例如《香港基督教協進會法團條例》(第1083章)第8條。 |
