释义 | 無法律規定者不為罪 Lat – there is no crime or penalty without law making it so. The basic principle of the criminal law that conduct cannot be punished unless there is a law declaring the conduct to be criminal and punishable. The principle denies the validity of any retrospective declaration of criminality without previous law making the conduct a crime: European Convention of Human Rights art 7; L'Office Cherifien v Yamashita Ltd (1993) 3 WLR 266; A Solicitor v Law Society of Hong Kong [1995] 2 HKC 541 (CA).
