释义 | 法定假日 A holiday that is granted by statute and generally observed by every person. Statutory holidays include Lunar New Year’s Day, the second day of Lunar New Year, the third day of Lunar New Year or, if any of these days falls on a Sunday, then the day immediately preceding Lunar New Year’s Day; Ching Ming Festival; Labour Day, being the first day of May; Tuen Ng Festival; the day following the Chinese Mid-Autumn Festival or, if that day falls on a Sunday, the Chinese Mid-Autumn Festival Day; the Chung Yeung Festival; the Chinese Winter Solstice Festival or Christmas Day, at the option of the employer; the first day of January; Hong Kong SAR Establishment Day, being the first day of July; and National Day, being the first day of October: Employment Ordinance (Cap 57) s 39. Employees are granted a statutory holiday by his employer on such days. However, an employer may grant instead the employee an alternative holiday on another day within the period of 60 days immediately preceding or next following the statutory holiday: s 39(2). An employer and his employee may agree that another day shall be substituted for a statutory holiday or an alternative holiday, if such substituted holiday falls within the period of 30 days of such statutory holiday, alternative holiday. Therefore, the maximum period when the substituted holiday had to be taken was 90 days from the statutory holiday: HKSAR v Yu’s Tin Sing Enterprises Co Ltd [2002] 1 HKC 491. Statutory holiday is different from the ‘general holiday’ or ‘public holiday’ under the Interpretation and General Clauses Ordinance (Cap 1) and the General Holidays Ordinance (Cap 149), which means a day which shall be kept as a holiday by all banks, educational establishments, public offices and Government departments. See also Public holiday. 由法規給予及每人一般會遵守的假日。法定假日包括農曆年初一,農曆年初二,農曆年初三或如該三日的其中一日適逢星期日,則為農曆年初一、二或三的前一天;清明節;勞動節,即5月1日;端午節;中秋節翌日,如該日適逢星期日,則為中秋節當日;重陽節;冬節或聖誕節(由僱主選擇);1月1日;香港特別行政區成立紀念日,即7月1日;及 國慶日,即10月1日:《僱傭條例》(第57章)第39條。僱員須在上述日子獲僱主給予法定假日。 但僱主可另選一日作為另定假日,以代替在法定假日給予僱員假日,而該另定假日是在緊接該法定假日前60天期間內或緊接法定假日後60天期間內:第39(2)條。假如有關的代替假日屬法定假日或另定假日的30天期間的範圍內,則僱主及其僱員可協意以另一日代替作為法定假日或另定假日。因此,須作出的代替假日的最高的期限是法定假日後90天期間內:HKSAR v Yu’s Tin Sing Enterprises Co Ltd [2002] 1 HKC 491。根據《釋義及通則條例》(第1章)及《公眾假期條例》 (第149章) ,法定假日與「公眾假期」或「公眾假日」不同,公眾假期指所有銀行、教育機構、公共機構辦事處及政府部門遵守為假期的日子。另見 Public holiday。 |
