释义 | 法定最高刑罰 The highest level of punishment that may be passed when sentencing. Generally, so far as imprisonment and the imposition of a fine is concerned, the penalty expressed in a statute is the maximum penalty that may be imposed. Where a penalty is prescribed for an offence in any Ordinance such a provision implies that the offence is punishable, upon conviction, by a penalty not exceeding the penalty prescribed; and if the amount of the fine is unspecified, that the offence will, without prejudice to any law against excessive of unreasonable fines or assessments, be punishable by a fine of any amount: Criminal Procedure Ordinance (Cap 221) s 101F. Subject to any principle or rule relating to particular offences, a court has a wide discretion in imposing sentence up to the maximum allowed, the maximum being reserved for the worst cases: R v Pang Chun Wai [1993] 1 HKC 233, [1994] 1 HKCLR 137.
