释义	法定最低限度 Any minima that is set down in legislation: an amount fixed by statute in relation to, for example, minimum rates of pay, minimum fines or minimum outstanding debts. For example, the court must first ask what is the minimum necessary to punish the offender if a prison sentence is necessary, to mark society’s disapproval of the offence and to act as a deterrent for the offender and other potential offenders who might be tempted to commit such a crime: R v Hitchcock (1982) 4 Cr App Rep (S) 160. The minimum amount will vary from statute to statute.
