释义 | 合法辯解 An excuse ‘supported by law’. A person is permitted to refuse to answer a charge if the person produces an excuse that the law recognises as valid: R v Wuyts [1969] 2 All ER 799, 2 QB 476 (CA). ‘Lawful excuse’ is an expression of wider import than lawful authority: Wong Pooh Yin, alias Kwang Sin, alias Ka Sin v Public Prosecutor [1955] AC 93; The Queen v Leung Wing Cheung [1958] 1 HKLR 49. ‘Lawful excuse’ is not exactly the same as ‘reasonable excuse’. It is not a lawful excuse if a person is ignorant of the law and thinks, albeit on reasonable grounds, that he has a legal right to do what he in fact does not: R v Tsang Chu Lun & Anor [1994] 1 HKC 769 (HC). A defendant has a lawful excuse if, on reasonable grounds, he is honestly mistaken as to a fact: Cambridgeshire and Isle of Ely County Council & Anor v Rust [1972] 2 QB 426; The Queen v Li Wing Tat & Ors [1991] 1 HKLR 731 (HC).
