释义 | 立法條約 A treaty concluded between a substantial number of states, that is legally binding only on the parties but is capable of general application by generating customary international law. A law making treaty may be evidence of customary rules and a source of international law: Statute of the International Court of Justice 1945 art 38 para 1(a). For a treaty provision to become a rule of customary international law, it must possess a ‘fundamentally norm-creating character such as could be regarded as forming the basis of a general rule of law’: North Sea Continental Shelf Cases (Federal Republic of Germany/Demark; Federal Republic of Germany/Netherlands) 1969 ICJ Rep 3.
