Creating detriment or prejudice. In criminal law, in deciding whether to admit evidence, a judge must consider whether the admission of such evidence would be unfairly prejudicial to an accused (R v Sang [1980] AC 402; R v Cheung Hon Yeung [1993] 1 HKC 26) and whether the prejudicial effect of which outweighs its probative value (R v Sang [1980] AC 402, [1979] 2 All ER 1222 (HL)). Confessions or admissions made involuntarily will also be excluded as the statement must not be obtained from the accused for fear of prejudice or in the hope of an advantage: S-J v Lam Tat Ming [2000] 2 HKC 693. In civil proceedings, evidence shall not be excluded on the ground that it is hearsay unless a party against whom the evidence is to be adduced objects to the admission of the evidence and the court is satisfied, having regard to the circumstances of the case, that the exclusion of the evidence is not prejudicial to the interests of justice: Evidence Ordinance (Cap 8) s 47(1).
