| 释义 | 事實的不可能性 The inability of a person to have committed an offence because, on the particular facts of the case, it would not have been possible to complete the offence in the manner in which the person is alleged to have committed the offence. For example, an attempt to make a prohibited drug by using a method which cannot produce that drug. In such circumstances, the offence of attempting to commit the crime will be proved if the prosecution establishes that the accused had an intention to commit the crime and did an act with that intent that went beyond mere preparation and cannot be reasonably regarded as having any other purpose than to commit the crime: R v Shivpuri [1986] 2 All ER 334, [1987] AC 1 (HL).
