Sexual intercourse is a continuing act and thus, if the woman revokes her consent during the course of the act of intercourse, further intercourse with the appropriate mens rea is rape: Kaitamaki v R [1985] AC 147, [1984] 2 All ER 435 (PC). In family law, an attempt without penetration is insufficient to constitute sexual intercourse: Dennis v Dennis (Spillett cited) [1955] P 153, 2 All ER 51 (CA).
