| 释义 | 優先日期 In relation to patent application, the date of filing an earlier application in a Paris Convention country for a patent or other protection for the same invention: Patents Ordinance (Cap 514) s 98(1). The proprietor of the designated patent application for the invention enjoys under the law of the designated patent office a right of priority for the period of 12 months after that date: s 98(1). In relation to registered design application, the priority date is the filing date of the first application. A person who has filed an application for registration of a design in a Paris Convention country or WTO member enjoys, for the purpose of registering the same design under Registered Designs Ordinance in respect of any or all of the same articles, a right of priority for the period of six months after the filing date of the first application: Registered Designs Ordinance (Cap 522) s 15(1). In relation to trade marks application, it is the date of filing of the first of any applications for the registration of a trade mark in a Paris Convention country or WTO member. A person who has duly filed such applications enjoys, for the purpose of registering the same trade mark under the Trade Marks Ordinance (Cap 559) in respect of any or all of the same goods or services, a right of priority for a period of six months beginning on the date of filing of the first of any such applications: Trade Marks Ordinance (Cap 559) s 41(1).
