释义 | 阻礙道路 Conduct that makes it impossible to proceed along a road, or that interferes in an appreciable way with the right that every member of the public has to use the road: Van Hing Transportation Co Ltd v A-G [1980] HKC 499. It is an offence to cause or permit any motor vehicle to stand on a road in such a position or in such condition or in such circumstances as to be likely to cause any unnecessary obstruction of such road or danger to other persons using the road without the consent of the relevant authority, or some other lawful excuse: Fixed Penalty (Traffic Contravention) Ordinance (Cap 237) s 4. For example, in some cases obstruction of the road may be authorised by law or agreement: Road Traffic Ordinance (Cap 374) s 125(2); Road Traffic (Expressway) Regulations (Cap 374Q) reg 18. It may be either temporary (Cheng Kin Ping v Woo Cho Wing John [2000] 4 HKC 158 (CFA)) or permanent (Scott v Green & Sons [1969] 1 All ER 849, 1 WLR 301 (CA).
