| 释义 | 淫褻 Matter which has a tendency to deprave and corrupt those whose minds are open to such immoral influences and into whose hands the matter may fall: The Queen v Hicklin [1968] LR 3 QB 360; Regina v Martin Secker & Warburg Ltd [1954] 1 WLR 1138. It is an offence to publish obscene articles: Control of Obscene and Indecent Articles Ordinance (Cap 390) s 21. Obscenity includes violence, depravity and repulsiveness: s 2(3). Obscenity is not confined to sex: John Calder (Publications) Ltd v Powell [1965] 1 All ER 159, 1 QB 509. The Obscene Articles Tribunal in deciding the question of obscenity and indecency shall have regard to (a) the standards of morality, decency and propriety that are generally accepted by reasonable members of the community; (b) the dominant effect of an obscene article or matter as a whole; (c) in the case of an article, the persons or class of persons, or age groups of persons, to or amongst whom the article is, or is intended to or is likely to be, published; (d) in the case of matter publicly displayed, the location where the matter is or is to be publicly displayed and the persons or class of persons, or age groups of persons likely to view such matter and (e) whether the article or matter has an honest purpose or whether its content is merely camouflage designed to render acceptable any part of it: s 10. Expert evidence is admissible in relation to matters which the Obscene Articles Tribunal must or may have regard: s 10(2).
