| 释义 | 完全成立信託 A trust constituted by a present declaration, or by the settlor transferring legal title to the intended trustee. If the intended object of a trust is a volunteer, the trust must be completely constituted. Thus to render a voluntary settlement valid and effective, the settlor must have done everything which, according to the nature of the property, was necessary to be done by the settlor to transfer the property: Milroy v Lord (1862) 4 De GF & J 264, 45 ER 1185. If an intended donor of property has done everything necessary to be done by the donor to transfer the legal title, the gift will be complete in equity: Corin v Patton (1990) 169 CLR 540, 92 ALR 1. A completely constituted trust binds all persons including the settlor, except the infamous bona fide purchaser of a legal estate for value without notice. Completely constituted and incompletely consisted trusts are distinguished from executed and executory trusts.
