| 释义 | 評估損害賠償 The process of quantifying the reasonable monetary value of a plaintiff’s loss. In tort law, the aim in assessing damages is to put the plaintiff in the position he or she would have been in had the tort not been committed: Doyle v Olby (Ironmongers) Ltd [1969] 2 All ER 119, 2 QB 158 (CA). In contract law, damages will be assessed on the basis of both loss of bargain (expectation loss) and damage suffered, including expenditure incurred, in reliance on the contract (reliance loss): Wertheim v Chicoutimi Pulp Co [1911] AC 301 (PC); C&P Haulage (a firm) v Middleton [1983] 3 All ER 94, 1 WLR 1461 (CA); The Rules of the High Court (Cap 4A) O 37 rr 1-6. An appeal from an assessment of damages lies to the Court of Appeal: The Rules of the High Court (Cap 4A) O 58 r 2(b). Also known as ‘measure of damages’ or ‘quantification of damages’.
