释义 | 調解/當庭和解 1. A method of alternative dispute resolution in which a third party attempts to facilitate an agreed resolution of a dispute in accordance with relevant legal principles. In Hong Kong, conciliation is distinguished from mediation in terms of the conciliator’s input to the substance of the agreement. 2. A discussion or action initiated or undertaken by a public officer, who has been authorised by the Commissioner for Labour, for the purpose of reaching a settlement of claim: Labour Tribunal Ordinance (Cap 25) s 2. 3. A discussion or action initiated or undertaken by a conciliation officer to assist the parties to a trade dispute to reach a settlement of the trade dispute: Labour Relations Ordinance (Cap 55) s 2. 4. International mandatory conciliation under the Convention on a Code of Conduct for Liner Conferences (Chapter VI) signed at Geneva on 6 April 1974: Merchant Shipping (Liner Conferences) Ordinance (Cap 482) s 2(1). Conciliation proceedings relating to a dispute are instituted when a party to the dispute requests that it be referred to conciliation and are completed when the conciliators notify the parties of their recommendation: Merchant Shipping (Liner Conferences) Ordinance (Cap 482) s 2(2). 5. A discussion or action initiated or undertaken by a public officer, who has been authorised by the Commissioner for Labour, for the purpose of reaching a settlement of a dispute in respect of which a claim may be brought before the Minor Employment Claims Adjudication Board: Minor Employment Claims Adjudication Board Ordinance (Cap 453) s 2. Family law - A process by which parties to a marriage or to a family law conflict are encouraged to resolve matters in dispute by discussion and negotiation rather than litigation. The neutral third party can be a court counsellor or registrar. Conciliation may be voluntary or court ordered. The term is sometimes used interchangeably with mediation. Mediation is mandatorily brought to the attention of the parties to a marriage, so that in case they both consent and are within cases suitable for mediation, a mediator may be appointed to solve their conflict by mediation before litigation: High Court Practice Direction 15.10.
