释义 | 義務人 1. In relation to a bond, the person who is bound under the bond. As an obligor is liable on the bond to fulfil the obligation or condition, the obligor must have full legal capacity to contract. 2. In relation to a guarantee, the principal debtor is the person primarily liable to the creditor for the obligation guaranteed. There can be no guarantee unless there is also a principal obligation, existing or contemplated, owed by a principal obligor: Lombard General Insurance Ltd v Edwin Engineering Ltd [1989] 2 HKC 438; Murjani v Bank of India [1989] 2 HKC 80 (CA).
