A sum of money ordered to be paid by a court which is equal to the value of benefits obtained by an offender as a result of the commission of a crime. The court has the power to impose a fine on any convicted person if it is not precluded from sentencing that person by the exercise of some other power: Criminal Procedure Ordinance (Cap 221) s 113A(1). The appropriateness of the imposition of a fine depends on whether the fine is an appropriate quantum for the offence and whether the offender has the means to pay the fine: R v Ambanta (HCMA 542/93, unreported); R v Leung Yee Keung [1988] HKC 569. The Criminal Procedure Ordinance (Cap 221) provides for a fine for an offence by reference to a level: Criminal Procedure Ordinance (Cap 221) s 113B(1), sch 8. See also Confiscation of profits.
