释义	叛逆罪 An indictable offence constituted by any of several acts, or an intention manifested by an overt act to do any such act, directed against the sovereign. A person commits treason if he kills, wounds or causes bodily harm to the President of the People’s Republic of China, or imprisons or restrains him or her, or forms an intention to do any such act as and manifests such intention by an overt act; levies war against the People’s Republic of China with the intent to depose the country from the style, honour and name of the Government of the Hong Kong SAR or of any other of its dominions, or in order by force or constraint to compel Central People’s Government to change its measures or counsels, or in order to put any force or constraint upon, or to intimidate or overawe, the National People’s Congress; instigates any foreigner with force to invade the People’s Republic of China or any of its territory; assists by any means whatever any public enemy at war with the People’s Republic of China; or conspires with any other person to do the above acts: Crimes Ordinance (Cap 200) s 2. The intention of the accused is important. If his intent is not to assist the enemy but merely do his duty in other regards, even if that had the effect of rendering such assistance, he is not guilty of treason: R v Ahlers [1915] 1 KB 616 (CCA). The Hong Kong SAR shall enact laws on its own to prohibit any act of treason, secession, sedition, subversion against the Central People’s Government: Basic Law art 23. 藉任何幾項行為，或藉公開的行為表明會作出任何針對主權的該等行為的意圖，而構成可公訴罪行。任何人有下述行為，即屬叛逆：殺死或傷害中華人民共和國主席，或導致中華人民共和國主席身體受傷害，或禁錮中華人民共和國主席，或限制中華人民共和國主席的活動；意圖作出上述的作為，並以公開的作為表明該意圖；向中華人民共和國發動戰爭，意圖廢除中華人民共和國作為香港特別行政區或其他領土的稱號、榮譽及名稱；或旨在以武力或強制手段強迫中央人民政府改變其措施或意見，或旨在向全國人民代表大會施加武力或強制力，或向其作出恐嚇或威嚇；鼓動外國人以武力入侵中華人民共和國；以任何方式協助與中華人民共和國交戰的公敵；或與他人串謀作出上述的事情：《刑事罪行條例》（第200章）第2條。重要的是被告人的意圖。若被告人沒有意圖協助敵人，但僅就其他方面執行其職務，縱使執行其職務時產生提供該協助的效果，該被告人亦不屬犯有叛逆罪：R v Ahlers [1915] 1 KB 616（英國刑事上訴法庭）。香港特別行政區應自行立法禁止任何叛國、分裂國家、煽動叛亂、顛覆中央人民政府及竊取國家機密的行為：《基本法》第23條。n.
