| 释义 | 代通知金 The practice of an employer who wants to terminate an employment contract by undertaking to pay a sum equivalent to the amount of wages which would have accrued to the employee during the requisite notice period: Employment Ordinance (Cap 57) s 7; Chu Hei Man, Qualia v Dynasty World Holdings Ltd (HCLA 58/99, unreported). Where the employment is terminated by a payment in lieu of notice, the employment will cease with immediate effect from the first day of the period by which the payment is calculated: Lee Kwok Chiu v Passport Travel Management (FE) Ltd (DCCJ 2093/98, unreported). As the right to terminate by making a payment in lieu of notice is recognised by statute, any contractual term which purports to restrict the exercise of such a right will be unenforceable: s 70. As a partial exception, it is open to either party to waive the need to terminate by making a payment in lieu.
