| 释义 | 金錢損失 The loss of an easily calculated sum of money. A plaintiff is entitled to recover damages in respect of pecuniary loss suffered as a result of the defendant’s tortious conduct or breach of contract, subject to the rules as to remoteness of damage and the plaintiff’s duty to mitigate: Chang Liang Hou v Italsider SpA [1981] HKC 508. Pecuniary losses include past pecuniary loss and future pecuniary loss, and cover such things as incurred expense and opportunity cost arising from paying money, or from withholding money, due to wrongful misrepresentation. The burden is on the plaintiff to prove the pecuniary loss: Wong Wang Sum v Lee Kam Engineering Co (A Firm) [1996] 3 HKC 627. If the plaintiff fails to prove the pecuniary loss on a balance of probabilities, nominal damages will be awarded: World Realty Ltd v Kwan Ngan Yin [1987] 3 HKC 148; Li Lai Fun v Chan Yan [1989] 1 HKLR 211.
