释义 | 阻撓警務人員 Interfering with the lawful execution of the duties of a police officer; making it more difficult for the police to carry out their duties: Hinchcliffe v Sheldon [1955] 3 All ER 406, 1 WLR 1207 (DC); Yuen Tai Biu v R [1978] HKLR 128 (CA). A person who wilfully obstructs any police officer in the due execution of his duty or any person acting in aid of such officer commits an offence: Offences Against the Person Ordinance (Cap 212) s 36; Gambling Ordinance (Cap 148) s 23(4). Warning a person against committing a crime, even though an officer is seeking to gather evidence against such a person, is not obstructing a police officer but, a warning during the course of the commission of an offence, directed to persons committing the offence, as to the presence of the police, is an obstruction: Betts v Stevens [1910] 1 KB 1 (DC). Where a person wilfully misleads a police officer who is seeking information which might lead to the conviction of a suspect, he is guilty of obstructing a police officer: Bastable v Little [1907] 1 KB 59 (DC).
