| 释义 | 臭氧層 A triatomic molecule of oxygen. It is a natural constituent of the atmosphere, with the highest concentration in the ozonosphere. Ozone provides a protection against incoming ultra-violet energy, which is a primary source of skin cancer. The release of chlorofluorocarbons and their dispersal into the upper atmosphere carries the risk of a depletion of the ozone layer and an increase in ultra-violet radiation to the earth’s surface. The Ozone Layer Protection Ordinance (Cap 403) was enacted to give effect to Hong Kong’s international obligations under the 1985 Vienna Convention for the Protection of the Ozone Layer (1985) 26 ILM 1529 and the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer (1987) 26 ILM 1550. Courts are under a duty to ensure that penalties imposed under the Ozone Layer Protection Ordinance reflect the community’s determination to observe its international obligations under the various environmental protection agreements: R v Tsui Chit Fan [1994] 2 HKCLR 273. The Ordinance prohibits the manufacture of substances that deplete the ozone layer, and controls the importation and exportation of such substances: Ozone Layer Protection Ordinance (Cap 403) ss 3, 4.
