| 释义 | 未獲解除破產的破產人 A bankrupt who has yet to be discharged. A bankrupt is discharged from bankruptcy by the expiration of the relevant period, ie four years, where a person has not previously been adjudged bankrupt, or five years, where a person has been previously adjudged bankrupt, beginning with the commencement of the bankruptcy, unless the trustee or one of the bankrupt’s creditors make a valid objection: Bankruptcy Ordinance (Cap 6) s 30A(1)-(3). There are many restrictions on an undischarged bankrupt: Bankruptcy Ordinance (Cap 6) ss 79A, 131; Companies Ordinance (Cap 32) ss 156(1), 278, 297A; District Councils Ordinance (Cap 547) ss 14(1)(g), 24(1)(g); Barristers (Qualification) Rules (Cap 159E) r 5; Barristers (Qualification For Admission And Pupillage) Rules (Cap 159AC) s 14.
