| 释义 | 優先的衡平法 An equitable claim to property which arose before another claim to, or interest in, the same property. Where two people hold inconsistent equities in the same property, the court will consider the conduct of the claimants to see if each took adequate steps to protect the interest held. Where prior equities are written, they are registrable under the Land Registration Ordinance (Cap 128) and if they are not so registered a bona fide purchaser who provides valuable consideration will take free of them: ss2-4.
