| 释义 | 國王安寧 Historically, a peace the breach of which attracted liability at the instance of the King. It was an element of manslaughter that the offence was committed against the King’s peace (contra pacem), in that only those under the King’s (or Queen’s) peace could be unlawfully killed. Killing in the heat of battle against the King’s enemies was permitted. However, the licence extended only to those deaths occurring in battle and not to killing prisoners: R v Dyson [1908] 2 KB 454 (CCA).
