释义 | 擊倒 In relation to an auction, the acceptance of a bid by an auctioneer, marked usually by the fall of the hammer at the highest bid. Once property has been ‘knocked down’ to the highest bidder, an oral contract for sale of that property arises. Until the property is actually knocked down there is no complete contract of sale: Halsbury’s Laws of Hong Kong, Vol 1, Auction [30.038]. After bidding has commenced, the auctioneer is liable in damages to the highest bidder for breach of the auction conditions if the auctioneer refuses to knock down the property to the highest lawful bidder: Warlow v Harrison (1859) 1 E & E 309.
