The invasion of a person’s right or violation of a duty arising from the repetition of acts and omissions of the same kind as that which gave rise to the initial cause of action against the wrongdoer. With a continuing breach, a fresh cause of action arises after recovery of damages in an earlier action, and the claimant may bring a second action to recover damages for loss arising after the earlier action. An example of continuing breach in contract is when a contract of employment stipulates that the employee should not during the period of service to his employer carry on or be concerned in other business of the same kind as the employer’s business and the employee does so. The employee is continuously in breach of the stipulation so long as the prohibited business is carried on. Another example is a continuing trespass in land by placing an object on another’s land without the other’s consent and failing to remove it within a reasonable time: Konskier v Goodman (B) Ltd [1928] 1 KB 421.
