By contrast, the term ‘guaranty’ is primarily used in banking and finance contexts in which A, usually the bank or financial institution, promises to pay B’s indebtedness to C. 3. In construction contracts, the due performance of a contractor’s obligations to complete the project will be guaranteed by some third party. 4. In marine law, an insurer may undertake to indemnify the assured against loss incidental to the marine adventure. Such latter contracts must be embodied in policies which are in compliance with the provisions of the Marine Insurance Ordinance: Marine Insurance Ordinance (Cap 329) s 22.
