Moral obligation |
An obligation which binds in conscience but does not give rise to legal consequences. For example, where precatory words in a will are ineffective, the provision may be regarded as imposing only a moral obligation but not a trust obligation: Re Norton’s Will Trusts [1948] 2 All ER 842. A moral obligation is something less than a trust obligation: Tito v Waddell (No 2) [1977] Ch 106. See also Precatory words; Trust. Re Norton’s Will Trusts [1948] 2 All ER 842。 |
