| 释义 | 無力償債 1. A debtor who is unable to pay debts as and when they fall due for payment. 2. The state of being unable to pay such debts. Bankruptcy - Inability to pay debts as they become due: Bankruptcy Ordinance (Cap 6) s 6A. Where a debtor is adjudged bankrupt and has at relevant time entered into transactions at undervalue with any person or given an unfair preference to any person, such acts could be set aside by the court: ss 49, 50. A person is deemed to be insolvent if he has either ceased to pay his debts in the ordinary course of business, or cannot pay his debts as they become due: Sale of Goods Ordinance (Cap 26) s 2(3). A company shall be deemed to be unable to pay its debts if a debt exceeding HK$5,000 then due remains unpaid three weeks after, or the execution of judgment, decree or order of the court remains unsatisfied, or if it is proved to the satisfaction of the court that the company is unable to pay its debt: Companies Ordinance (Cap 32) s 178(1). If a debt that is not substantially disputed is unpaid, the court may infer that the company is insolvent: Re United Strength Ltd [1992] 1 HKC 386 (HC); Cornhill Insurance plc v Improvement Services Ltd & Ors [1986] 1 WLR 114.
