A privilege, right or claim which is based on moral considerations or ethical principles and which should be recognised by law but is not legally imposed or enforced as such. Morality and legality are related but not identical. Thus an act may be considered morally reprehensible although it does not give rise to a legal cause of action. The courts may recognise certain moral rights and duties between the parties but they will not intervene unless such moral rights or duties are embodied in corresponding legal rights and obligations. 基於道德考慮或職業道德原則的特權、權利或申索,它應得到法律的認可,但卻不由法律施加或強制執行。道德與合法性有關聯但卻不儘相同。因此某行為可能是道德上應受譴責,但卻不產生法律上的訴訟因由。法庭可承認各方之間的某道德上的權利及責任,但卻不會干預,除非該道德上的權利及責任包含在相應的法律權利及責任內。另見 Legal right。
