| 释义 | 協助及教唆 To assist and to encourage. Criminal law - To assist in the commission of a crime without actually participating in the offence itself. A reference to an offence in any Ordinance is deemed to include a reference to aiding and abetting of that offence: Criminal Procedure Ordinance (Cap 221) s 101C. An accused who aids and abets must be shown to have been in some way linked in purpose with the person actually committing the principal offence, and the accused’s words or conduct must encourage or render more likely the commission of the crime by the principal: R v Lau Chi Kin [1988] 1 HKLR 282 (CA). Mere presence at the scene is not sufficient: Kwan Kwok Hing v R [1977] HKLR 159 (HC). A person who aids and abets the commission by another person of any offence shall be guilty of the like offence and be liable to the same punishment as the principal: Criminal Procedure Ordinance (Cap 221) s 89; A-G v Sin Wai Lun [1988] 1 HKLR 580 (CA).
