In strict liability offences, the word ‘knowingly’ indicated a clear requirement of mens rea as an element of an offence: Sweet v Parsley [1969] 1 All ER 347, 53 Cr App Rep 221, [1970] AC 132 (HL); HKSAR v Paul Y-ITC Construction Ltd & Anor [1998] 1 HKC 75. Generally it implies that the prosecution must not only prove that the accused intended his act but knew the nature of it: R v Hallam [1957] 1 QB 569, 1 All ER 665, 2 WLR 521 (CCA).
