释义 | 海運貨單 A receipt issued by a shipping line to a shipper for the merchandise shipped. A sea waybill is evidence of the contract of carriage and resembles a bill of lading, but it is not a document of title. It is not a negotiable document, and is therefore not a bill of lading for the purposes of the Bills of Lading and Analogous Shipping Documents Ordinance (Cap 440) s 3(3). It bears the name of the consignee who has only to prove his, her, or its identity in order to receive take delivery of the cargo. The purpose of a sea waybill is to avoid the delays to ships and cargoes that occur when bills of lading are late in arriving at the port of discharge. The Hague-Visby Rules will not apply to a sea waybill, unless otherwise expressly provided: Carriage of Goods by Sea Ordinance (Cap 462) s 3(4)(b). Also known as ‘non-negotiable bill of lading’ or ‘straight bill of lading’.
