释义 | 查冊 The process of identifying the title to a property conducted by the purchaser’s solicitors in the appropriate Land Registry in Hong Kong prior to the execution of the contract. There should be at least two searches to be conducted. The first search may be either a historical search extending back to the Government lease or conditions of grant or a current search disclosing details of current ownership only. Searches can now be undertaken directly through computer link-up with the Land Registry if the solicitor’s firm is connected. The searcher will obtain the computerised ‘Property Particulars’ showing details of all owners and encumbrances on the Land Registrar. The records provided to the searcher however only cover documents already entered on the register. Thus, as to documents which have been submitted for registration but have not yet appeared on the register, the searcher must also check the Memorial Day Book and Register Card Index provided in each register: Sihombing & Wilkinson, A Student’s Guide to Hong Kong Conveyancing (2nd Ed) ch 6 pp 383-384.
